Terms and Conditions
1. Copyright Warranty and Indemnification:
By submitting media for digitization, I affirm that the materials provided are either (a) my original content, (b) public domain content, or (c) content for which I have obtained the necessary rights and permissions for duplication and use. I agree to indemnify and hold Family Media Transfer harmless from any claims, liabilities, or legal actions arising from alleged copyright infringement related to the submitted media.
2. Ownership of Media:
I retain full ownership rights to all media submitted for digital conversion. Family Media Transfer acknowledges that it does not claim any rights, title, or interest in the submitted media and will use the materials solely for the purpose of providing digitization services.
3. Limitation of Liability for Material Loss or Damage:
Family Media Transfer will handle all submitted media with the utmost care. However, I acknowledge that the company is not liable for any loss or damage to the materials during transit via mail or courier. Additionally, Family Media Transfer is not responsible for loss or damage resulting from unforeseen circumstances such as fire, flood, theft, or other natural disasters.
4. Payment and Financial Terms:
Payment for digitization services is due upon order placement unless otherwise agreed upon in writing. Family Media Transfer reserves the right to withhold completed digital files until full payment is received. Any additional charges incurred due to special requests or modifications will be communicated before processing. Refunds will be considered on a case-by-case basis in accordance with the satisfaction guarantee outlined in Section 5.
5. Quality Assurance and Satisfaction Guarantee:
Family Media Transfer is committed to providing high-quality digitization services. If I am dissatisfied with the final product, I may request modifications or corrections within 30 days of payment. Refunds, whether full or partial, will be granted at the company's discretion based on the nature of the issue.
6. Return of Materials:
I agree to retrieve or arrange for the return of all original and digitized media within 30 days following the completion of the digitization process. Family Media Transfer is not responsible for storing unclaimed materials beyond this period and reserves the right to dispose of or return them at my expense if not collected in a timely manner.
7. Privacy and Data Security:
Family Media Transfer values customer privacy and will not share, distribute, or use any submitted media for purposes beyond the agreed digitization service. All digital conversions are handled securely, and media files are only retained for a limited time post-completion to allow for quality assurance and customer access. After this period, digital files may be permanently deleted.
8. Service Limitations:
While Family Media Transfer strives to restore and enhance media quality, I acknowledge that the final digitized product is subject to the quality of the original material. The company does not guarantee full restoration of degraded or damaged media but will apply the best available techniques to improve clarity and usability.
9. Agreement Acknowledgment:
By submitting media to Family Media Transfer, I acknowledge that I have read, understood, and agreed to these Terms and Conditions. This agreement represents the entire understanding between myself and Family Media Transfer regarding the provided services.
These Terms and Conditions are subject to change. Any modifications will be communicated prior to taking effect.
